1 Scope of Application

1. These General Terms and Conditions govern all business relationships between
   by Amanda Highclass Escort, hereinafter referred to as the “Agency”,
   and its clients, hereinafter referred to as the “Client”.
2. The GTC apply to:
   • agency services,
   • bookings of escort services,
   • as well as member memberships.
3. Any deviating terms of the Client shall not become part of the contract unless expressly agreed to in writing.

2 Subject of Contract and Agency Services

1. The Agency provides mediation services in the field of escort and companionship services.
2. The Agency acts exclusively as an intermediary.
   A contract for the actual escort service is concluded solely between the Client and the respective model.
3. The Agency does not owe any specific success, but solely the proper mediation of services.

3 Conclusion of Contract

1. A booking request constitutes a non-binding offer by the Client.
2. The contract is only concluded when:
   • the requested model confirms the booking, and
   • the Agency confirms the booking to the Client.
3. Models are free in their decision to accept a booking.

4 Fees and Payment Terms

1. The agreed fees apply exclusively to the agreed duration and companionship.
   Any additional services are not part of the contract.
2. Available payment methods:
   • Bank transfer
   • Credit card
   • Western Union
   • Cash payment directly to the model
3. In the case of bank transfer, payment shall be made to the account specified by the Agency.
4. If payment is made in a currency other than Swiss Francs (CHF) or EUR (EURO), conversion shall be based on the daily exchange rate applicable on the date of receipt of payment.
5. For credit card payments, an additional processing fee of 5% of the total booking amount will be charged.
6. In the case of cash payment, the full fee must be handed over at the beginning of the meeting in an open envelope.
   The model must be given the opportunity to verify the amount.
7. Invoices will only be issued upon explicit request prior to the appointment.

5 Deposits

1. For longer bookings, travel arrangements, or increased organizational effort, a deposit may be required.
2. The amount of the deposit shall be agreed individually and confirmed in writing.
3. Deposits may be made via bank transfer or credit card.
4. Deposits serve to secure the booking and may be retained in whole or in part in the event of short-notice cancellation.
5. For new clients, a mandatory deposit of 40% of the booking amount will be charged.

6 Cancellation

1. Cancellations must be communicated without delay.
2. If cancellation occurs less than 24 hours before the start of the appointment, a lump-sum compensation may be charged.
3. Any travel or organizational costs already incurred will be charged in all cases and deducted from any refundable amounts.
4. If the model cancels, any deposit paid will be refunded in full.

7 Obligations of the Client

1. The Client undertakes to behave respectfully and in compliance with the law.
2. Criminal or inappropriate behavior will result in the immediate termination of the appointment without any claim to a refund.

8 Member Membership

1. The Agency offers a paid member membership called “Secret Room”.
2. The membership is valid for a period of 6 months from the conclusion of the contract.
3. The membership includes:
   • uncensored and unpixelated access to model photos,
   • access to additional video and audio files (if available),
   • access to exclusive special events,
   • discounts on booking prices,
   • VIP status,
   • priority processing of booking requests compared to non-members.
4. The Member undertakes to use all content exclusively for personal use.
5. It is strictly prohibited to:
   • reproduce content,
   • download it,
   • copy it,
   • photograph it,
   • store it,
   • or pass it on to third parties.
6. In the event of a violation, the Member undertakes to pay an appropriate contractual penalty.
   Further civil and criminal legal steps remain expressly reserved.

9 Copyright

1. All website content, in particular images, texts, videos and audio files, is subject to copyright.
2. Any use beyond the expressly permitted use requires the written consent of the Agency.

10 Liability

1. The Agency shall only be liable for damages caused intentionally or by gross negligence.
2. Liability for slight negligence is excluded to the extent permitted by law.
3. The Agency assumes no liability for services provided by the mediated models.
4. Liability for indirect damages, consequential damages or loss of profit is excluded.

11 Data Protection

1. The processing of personal data is carried out in accordance with the provisions of the Swiss Federal Act on Data Protection (FADP).
2. Details can be found in the separate privacy policy.

12 Place of Jurisdiction and Applicable Law

1. Swiss law shall apply exclusively, excluding international conflict of law rules.
2. Place of jurisdiction is Cham, Canton of Zug.

13 Severability Clause

Should individual provisions of these GTC be wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
In place of the invalid provision, a legally permissible provision shall apply that most closely reflects the economic purpose of the invalid provision.
